Interlock and patios we build in Hamilton

Do you need a permit for interlock in Hamilton?
Most of the time, no. An interlock or paver patio or walkway laid at grade is landscaping, and Hamilton doesn't require a building permit for it. The exception is when a patio stops being at-grade and becomes an elevated, deck-style structure raised above the ground. Then it follows the deck rules instead: a building permit is required once it's attached to the house, sits more than 0.6 m (about 24 inches) above grade, or serves a pool.
Permit or not, a few rules still apply to any hardscape:
- Lot coverage and setbacks. There are limits on how much of the lot can be covered and how close hard surfaces sit to the property lines. We confirm those with the City before we start.
- Grading. The finished surface has to move water away from the house, and it can't push runoff onto a neighbour's land. That isn't just good practice, it's the rule.
- Pools. If the patio runs up to a pool, the pool-enclosure rules apply on top of everything else.
- Driveways. A new or widened interlocking driveway has to meet the lot-coverage, grading, and setback rules, and a new or widened entrance onto the road can need the City's sign-off. We check before we dig.
There's one more layer near water or slopes. If your lot sits near a watercourse, a floodplain, a wetland, or a steep slope, the Hamilton Conservation Authority (HCA) may require a permit before any site alteration under Ontario Regulation 41/24. Most backyard patios aren't in a regulated area, but we check and confirm with the HCA before we break ground. The same crew handles our excavation work, so the base dig stays in-house from the first cut.
The base is the job
The stone you see is the easy part. What decides whether interlock lasts is the base under it, and that's where Ontario's freeze-thaw winters do their damage. Water gets into a thin or poorly compacted base, freezes, swells, and lifts the pavers. Come spring it drops them again, and within a season or two the patio heaves, dips, and ruts.
We build the base so that can't happen:
- Excavate to depth. We dig out the soft ground first, down to the depth the job calls for, not laying stone on whatever's there.
- Compacted granular. We bring in clean granular, lay it in lifts, and compact each one. The base goes deeper on clay and deeper for anything driveable. A driveway base is thicker than a patio base because it carries far more weight.
- Edge restraint and jointing sand. A solid edge restraint locks the perimeter so the pavers can't creep, and jointing sand fills the joints so the field stays tight.
- Grade built in. We pitch the surface so water sheets off and away from the house, not toward the foundation and not onto the lot next door.
Hamilton ground makes the base matter even more. Heavy clay up on the Mountain and out toward Ancaster holds water and heaves hard, so a thin base there fails fast. Escarpment-edge lots can sit on shallow soil over rock. Nearer the harbour and the North End the ground turns to sandier loam that drains easier but still needs a base that's dug and compacted right. We read the soil before we set the depth. If a grade change needs holding back, we build retaining walls too, with the drainage that keeps a wall standing.

- Edge and joint. We lock the perimeter with edge restraint and sweep in the jointing sand so the field stays tight.

Frequently asked questions
Do I need a permit for a paver patio in Hamilton?
Usually not. An interlock patio or walkway laid at grade is landscaping and doesn't need a building permit in Hamilton. Why does interlock heave or sink after a winter or two?

We excavate to depth and compact the base in lifts, deeper on clay, so it doesn't move. The pavers are only as good as what's under them.
Can you build an interlocking driveway in Hamilton?
Yes. A paver driveway is built on a deeper, heavier base than a patio because it carries vehicle weight without rutting. Will clay soil up the Mountain wreck my patio?
Not if the base is built for it. Heavy clay around the Mountain and toward Ancaster holds water and heaves harder than sandier ground, so we dig deeper and compact more granular under interlock there. The grade also has to carry water away. Done right, a paver patio on clay holds its line just fine.
Can a paver walkway fix a tired front yard?
Often, yes. A lot of older lots in Durand and Corktown have a cracked walk and a patchy entrance, and a clean paver walkway ties the whole front together. We match the pattern and colour to the house and build the base so the walk stays level for the long run.
Do you offer permeable interlock?
Yes. Permeable pavers let water soak through into an open-graded stone base instead of running off, which helps on lots where runoff is a problem. The base is built differently than a standard patio, so we'll tell you at the quote whether permeable is the right call for your yard.
