Footings that hold through a Hamilton winter
A deck is only as good as what holds it up. Ontario's freeze-thaw winters are rough on shallow footings. Wet soil freezes, swells, and lifts anything sitting too close to the surface, then drops it again in spring. That's frost heave, and it's what racks a deck or tilts a set of stairs within a season or two.
The Ontario Building Code (Part 9) deals with this through depth. Around Hamilton and Halton, deck footings have to bear on undisturbed soil 1.2 m (4 ft) below grade, below the frost line. We dig to that depth on every footing. No shortcuts, no surface blocks pretending to be a foundation.
Hamilton ground makes this matter more. Heavy clay is common up on the Mountain and out toward Ancaster, and clay holds water and heaves hard. Escarpment-edge lots around Dundas can sit on shallow soil over rock. Nearer the lake you get sandier loam. The fix is the same everywhere: get the footings down past frost on solid ground, and move water away from the structure.
Deck permits in Hamilton
Hamilton follows the Ontario Building Code on deck permits. You generally need a building permit if your deck:
- is attached to the house,
- sits more than 0.6 m (about 24 inches) above grade at any point, or
- serves a pool, above-ground or in-ground.
A small freestanding deck in the rear yard usually skips the permit if it stays 0.6 m (24 inches) or less off the ground and 10 m² (about 108 sq ft) or smaller. Zoning setbacks still apply, so it isn't a free-for-all. The Code also calls for guards anywhere the walking surface sits more than 0.6 m above grade.
We confirm the permit situation with the City before we dig, and we build to Code either way. Planning a privacy fence too? Hamilton's fence by-law (10-142) allows up to 2.0 m (6'6") in the rear and side yards, and 0.9 m (3 ft) within 3 m of the front lot line or inside a corner-visibility triangle. A fence built on top of the deck can reach 2.0 m measured from the deck surface, set back from your lot lines. We also build fences if you want both done by one crew.
Wood or composite: what lasts here
Most decks we build start with a pressure-treated frame. It's strong, it's proven in this climate, and it keeps the structural cost sensible. For the surface you've got a choice:
- Pressure-treated lumber: the budget-friendly pick. It needs cleaning and re-staining every couple of years to fight the wet-dry cycle.
- Composite boards: more up front, close to zero upkeep, and they shrug off Ontario's winters without splitting or greying.

Can you build a deck on a sloped Hamilton lot?
