Do you need a permit for concrete in Hamilton?

For most flatwork, no. At-grade concrete, a driveway, a walkway, a patio, or a slab on grade, generally needs no building permit in Hamilton. What still applies is the zoning side: grading, lot-coverage, and setback rules. The grade has to move water away from the house and never push runoff onto a neighbour's land, and a slab can't eat into the coverage or the setbacks your lot allows. We confirm that with the City before we form anything.

One more layer catches some lots: the conservation authority. If your property sits near a watercourse, a floodplain, a wetland, or a steep slope, the Hamilton Conservation Authority (HCA) may require a permit before any site alteration under Ontario Regulation 41/24. We check whether your lot falls in a regulated area and confirm with the HCA before we break ground.

Concrete that survives Ontario winters

Concrete that fails here usually fails the same way: the surface flakes, pits, and spalls after a few winters of salt and freeze-thaw. The fix is the mix and the base, and we don't cut either.

For exterior flatwork in Hamilton we pour air-entrained concrete, 5 to 7 percent air, CSA Class C-2 at around 32 MPa, with a low water-cement ratio and freeze-thaw-durable aggregate. The tiny air bubbles give freezing water somewhere to go instead of cracking the surface apart, and that's exactly what stands up to the road salt our winters throw at a driveway and front walk. Driveable slabs get rebar or mesh so the load doesn't crack them.

Under the slab goes a compacted granular base. Nearer the harbour and the North End the ground turns to sandier loam that drains easier, but it still wants a properly compacted base so the slab doesn't settle. We read the ground before we pour, and where the base needs real digging and grading, we do that excavation ourselves.

Then we control the cracking instead of hoping against it. Concrete moves, so we cut control joints no more than 2.5 m apart, about a quarter of the slab's depth, to steer the cracks into the joints where you won't see them. And we cure it properly, keeping it wet and protected so it gains strength instead of drying out brittle. Skip the cure and the best mix in the world still scales.

Do I need a permit to replace my concrete driveway in Hamilton?
