The fences we build in Dundas

Where the fence goes: property lines first
Before we dig, we sort out where the line actually is. A fence built a few inches over the boundary causes more grief than any post ever will.
If you have a survey (the Surveyor's Real Property Report), we work off it. If you don't, we walk the line with you, check the pins, and keep the fence clearly on your side unless you and your neighbour agree to share it and split the cost. On a shared line we face the good side out where it makes sense. Older downtown Dundas lots often have fences that drifted over the years, so we measure twice before anything goes in the ground.
Setting posts is the part that lasts
A fence stands or falls on its posts. Southern Ontario's freeze-thaw winters are hard on anything set shallow. Wet soil freezes, swells, and lifts the post, then drops it again in spring. That's frost heave, and it's what tilts a fence and racks a gate within a season or two.
The fix is depth. We set posts down toward the 1.2 m (4 ft) frost line that footings bear to in the Hamilton area, on a frost-stable base, and we keep every post plumb. Near the escarpment edge in Dundas the ground can turn to shallow soil over rock, so some holes hit stone before frost depth. We deal with that on site rather than leave a post sitting in loose fill that will move.
Spencer Creek runs through the valley and the water table sits high in spots. Wet ground heaves harder, so depth and drainage matter even more on the low lots.
Fences on Dundas slopes
Dundas climbs. Yards off Sydenham Hill and up toward the escarpment drop away fast, and a fence has to deal with the grade. We build it one of two ways:
- Stepped. Each panel stays level and steps down the slope like stairs. Works on any grade, including the steep ones. It leaves small triangle gaps at the bottom, which we can close in if you've got a dog.
- Raked. The rails follow the slope so the fence line stays parallel to the ground, with no gaps. It looks cleaner but only works up to a moderate grade, and not every panel style racks.

Dundas fence by-law: how high can your fence be?
Dundas is part of the amalgamated City of Hamilton, so your fence falls under Hamilton's Fence By-law 10-142. The heights that matter:
- Rear and side yards: up to 2.0 m (6 ft 6 in). That covers a standard backyard privacy fence.
- Front yard: 0.9 m (3 ft) within 3 m of the front lot line, and inside any corner or driveway visibility triangle. The low limit keeps sightlines clear for drivers and people on the sidewalk, which matters on Dundas's tight corner lots downtown.
- A gate may go 0.3 m over the limit, and decorative post caps another 0.15 m.
- A fence on top of a deck or platform can reach 2.0 m measured from the deck surface, when it's set back from your lot lines.
There's no fence permit in Hamilton, but the by-law still applies, and the City can act on a complaint. Pool enclosures are governed by a separate by-law, so a fence doubling as a pool fence has its own rules. We build to 10-142 either way.
Thinking about a deck too?
Plenty of Dundas jobs are a fence and a deck together, and decks follow a different rule. In Hamilton you generally need a building permit if the deck is attached to the house, sits more than 0.6 m (about 24 inches) above grade, or serves a pool. A small, low, freestanding deck in the back yard usually skips the permit, but the zoning setbacks still apply. We sort the permit before we dig and build to Code. Can I build a fence right on the property line in Dundas?
You can, if you and your neighbour agree to share it and split the cost. Otherwise we keep the fence on your side of the line. We work off your survey when you have one, or walk the pins with you when you don't. On the older lots near King and Sydenham, fences have often crept off the line over the years, so we confirm it before digging.
Do I need a permit for a fence in Dundas?
No. Hamilton doesn't require a fence permit, and Dundas falls under the City of Hamilton. The Fence By-law 10-142 still governs height and placement, and the City can act if a neighbour complains. Pool fences are the exception, covered by a separate enclosure by-law. We build to the by-law so it isn't a problem down the road.
How do you fence a steep Dundas yard?
