The fences we build in Ancaster

Where your fence goes: property lines and shared lines
A fence has to sit on your land unless you and your neighbour agree to put it right on the boundary. Before we dig, we want to know where that line actually is. On the older lots around Old Ancaster village off Wilson Street, the line on the ground and the line on paper don't always match. Shared boundary fences are common here. If you and the neighbour are splitting a line, we build to suit both yards and settle who's paying for what before any post goes in. The City's division-fence by-law covers cost-sharing on a true boundary fence, but the simplest path is a clear deal with your neighbour up front.
Setting posts that don't heave
The post line is the part of a fence that fails first, and in Ancaster the reason is usually frost. Southern Ontario's freeze-thaw winters push wet soil up when it freezes and drop it in spring. A post set too shallow rides that movement. A year or two later the fence is leaning and the gate won't latch.
The fix is depth. We set posts down toward the local frost line, 1.2 m (4 ft) below grade in the Hamilton area, on a frost-stable base so the ground can't grab and lift them. That matters more in Ancaster than most places. A lot of the ground here is heavy clay, and clay holds water and heaves hard. Bigger mature lots in Meadowlands and Spring Valley also mean longer fence runs, so every post has to go in the same way down the whole line, or the fence telegraphs the one you skipped.
Mature trees come into it too. Established yards near the escarpment brow are full of root systems. We'll shift a post or hand-dig around a major root rather than cut through it and lose the tree.
Ancaster fence by-law: how high can your fence be?
Ancaster is part of the City of Hamilton, so it runs on Hamilton's Fence By-law 10-142. The short version:
- Rear and side yards: up to 2.0 m (6 ft 6 in), the standard privacy-fence height.
- Front yard: within 3.0 m of the front lot line the limit drops to 0.9 m (3 ft)The same 0.9 m cap applies inside a corner or driveway visibility triangle, so drivers and people on the sidewalk can see.
- Gates and caps: a gate may run 0.3 m over the limit, and decorative post caps another 0.15 m.
- On a deck: a fence built on a deck or platform can reach 2.0 m measured from the deck surface, set back from your lot lines.
You don't need a permit to put up a fence in Hamilton, but the by-law still applies, and pool fences fall under their own enclosure rules. Decks: different rules, same crew
A lot of fence jobs turn into fence-and-deck jobs, and we build both. The permit rules are different, though. In Hamilton a deck needs a building permit if it's attached to the house, sits more than 0.6 m (about 24 inches) above grade, or serves a pool. A fence needs none of that. Do I need a permit to put up a fence in Ancaster?
No. Hamilton doesn't require a fence permit, and Ancaster runs on the same by-law. The one exception is a pool fence.
