Permits and engineering for a retaining wall in Stoney Creek
Height is what decides how involved a wall gets. Under the Ontario Building Code, a retaining wall over about 1.0 m (3 ft) of exposed height, or one holding back a surcharge like a driveway, a building, or a steep slope above it, is a designated structure under Part 4. That means it needs a building permit and an engineered design, usually with a geotechnical review of the soil. We handle that side: we bring in the engineering, pull the permit, and build the wall to the stamped drawings.
Under about 1 m, a wall usually needs no permit. That does not mean it can be thrown together. A short wall built without a proper base and drainage fails the same way a tall one does, just slower. We build the small walls to the same standard, permit or not.
There's a second approval to know about. Stoney Creek is part of the City of Hamilton, so the conservation authority here is the Hamilton Conservation Authority (HCA)Under Ontario Regulation 41/24, a permit is required before site alteration in a regulated area, near a watercourse, a floodplain, a wetland, or a steep slope. A wall near the escarpment edge, a ravine, or a creek can fall under that, and if your lot climbs toward the brow past the Devil's Punch Bowl or Felker's Falls, escarpment-protected land can add another layer. We confirm it all with the City and the HCA before we break ground, not after.
And before any digging, the locates go in. By law in Ontario, anyone breaking ground has to request locates through Ontario One Call so the gas, hydro, water, and telecom lines get marked first. It's free, and we book it on every job, post hole or full footing.
Drainage and base: why walls last
Retaining walls almost never fail because the blocks weren't strong enough. They fail because of water and frost. Soil behind a wall soaks up rain and snowmelt, and with nowhere to go that water builds hydrostatic pressure that pushes the wall out. Then Ontario's freeze-thaw goes to work: the wet soil freezes, swells, and shoves, then thaws and lets go, over and over through the winter. A wall with no drainage leans, then bulges, then comes apart.
The fix is the same on every wall we build, and it's all the stuff you can't see once it's done:
- A compacted granular base. We excavate to solid ground and lay a level, compacted base so the wall isn't sitting on soil that will settle.
- Drainage behind the wall. Clear stone against the back of the wall and a perforated weeping tile at the base, so water drains down and out instead of collecting and pushing.
- Compacted backfill. Filled and tamped in lifts so the ground behind the wall stays put.
- Geogrid on the taller block walls. Layers of grid run back into the slope and lock the wall to the soil mass behind it, so it can't tip.
Depth matters too. Where a wall carries a poured footing, that footing has to bear below the frost line, about 1.2 m (4 ft) down in this part of southern Ontario, so it doesn't heave.
Stoney Creek soil changes the recipe depending on where you are. Out through Winona and Fruitland, the old fruit lands east of town, and down toward the Lake Ontario shoreline, the ground runs sandier and drains quicker. Up on the Mountain and around Heritage Green it turns to clay that holds water and heaves hard, so the drainage behind the wall has to work that much harder. We read the soil on your lot and build the base and drainage to suit it. Some of that is excavation and haul-off, its own excavation work we handle in-house on the same job.

Frequently asked questions
Do I need a permit for a retaining wall in Stoney Creek?

Why do retaining walls lean or bulge over time?
Almost always water and frost. Without drainage behind it, a wall traps water, that water builds pressure, and Ontario's freeze-thaw cycle pushes the wall out a little more every winter. That's why we put clear stone, a weeping tile, and compacted backfill behind every wall. The drainage is what keeps it standing straight.
Can you build a retaining wall on a steep Stoney Creek Mountain lot?
Yes. Stepping a wall up an escarpment grade is common on the Mountain. We size the base, the reinforcement, and the drainage for the slope, and where the height or a surcharge calls for it, we build to an engineered design. Steep ground is the norm up there, not a problem. Taller walls often get built in tiers.
